1. Introduction & Acceptance

Welcome to VacPack ("we," "us," "our," or "VacPack"). These Terms & Conditions ("Terms") govern your access to and use of the VacPack website, products, services, and any related offers (collectively, the "Services"). By placing an order, creating an account, subscribing to our communications, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our Services or place an order.

These Terms constitute a legally binding agreement between you and VacPack. We reserve the right to update, modify, or replace these Terms at any time without prior notice. It is your responsibility to review these Terms periodically. Continued use of the Services after any changes constitutes acceptance of the revised Terms.

2. Product Information & Descriptions

VacPack offers vacuum-compression travel products, including but not limited to the VacPack backpack, VacCase suitcase, replacement bags, pumps, and related accessories (each a "Product" and collectively, "Products"). All product descriptions, images, specifications, pricing, and availability are subject to change at any time without notice.

While we make reasonable efforts to display our Products and their colors accurately, we cannot guarantee that your device's display will reflect the true color, texture, or appearance of any Product. Product dimensions and capacities are approximate and may vary slightly due to manufacturing tolerances.

We do not warrant that any Product is suitable for every airline, travel scenario, or personal need. It is your responsibility to verify airline baggage policies, dimensions, and weight restrictions before traveling with any VacPack Product.

3. Ordering, Pricing & Payment

By submitting an order through our website, you represent that you are at least 18 years of age or the legal age of majority in your jurisdiction and that the payment information you provide is valid, accurate, and authorized for use.

All prices are listed in United States Dollars (USD) unless otherwise indicated. Prices do not include applicable taxes, duties, or shipping fees, which will be calculated and displayed at checkout. Promotional pricing, discount codes, bundle offers, and free shipping promotions are subject to expiration and may not be combined unless explicitly stated.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, suspected fraud, or violations of these Terms. If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

4. Important Disclaimer — No Guarantee of Receipt

PLEASE READ THIS SECTION CAREFULLY. WHILE VACPACK TAKES EVERY COMMERCIALLY REASONABLE STEP TO PROCESS, SHIP, AND DELIVER YOUR ORDER, WE DO NOT GUARANTEE THAT YOU WILL RECEIVE THE ITEMS YOU PURCHASE.

Order fulfillment, warehousing, packaging, shipping, and delivery are handled by independent third-party logistics providers, fulfillment centers, and shipping carriers (collectively, "Fulfillment Partners"). Once an order leaves our facility or the facility of a Fulfillment Partner, delivery is outside of our direct control. Delays, loss, theft, damage, misdelivery, customs holds, failed delivery attempts, incorrect addresses, and other shipping disruptions can and do occur.

By placing an order, you acknowledge and agree that:

  • VacPack is not responsible or liable for the acts, omissions, negligence, delays, errors, or failures of any Fulfillment Partner, warehouse, manufacturer, or shipping carrier.
  • We do not guarantee delivery dates, shipping windows, transit times, processing times, or that your order will arrive at all.
  • Extended, slow, or delayed shipping and fulfillment timelines — including delays of days, weeks, or longer — are an inherent risk of ordering and do not entitle you to a refund, cancellation, or chargeback (see Section 7).
  • Risk of loss and title for items purchased pass to you upon tender of delivery to the carrier.
  • If a Fulfillment Partner is unable to fulfill, ship, or deliver your order for any reason — including inventory shortages, operational shutdowns, staffing issues, force majeure events, weather, customs holds, or carrier failures — your sole and exclusive remedy is to allow VacPack a commercially reasonable period of time to work with the Fulfillment Partner and carrier to resolve the issue, which may include, at VacPack's sole discretion, a reshipment or replacement of the affected items.
  • You agree to cooperate in good faith with VacPack, the Fulfillment Partner, and the carrier in any investigation, claim, trace, or resolution effort related to a delayed, missing, or damaged shipment, including allowing reasonable time for the shipment to arrive or for a replacement to be dispatched before escalating any dispute.
  • You expressly waive any right to initiate a payment dispute, chargeback, or reversal on the basis of a delayed or not-yet-received order while VacPack is actively working in good faith to resolve the fulfillment issue.

We are actively working with our Fulfillment Partners on any known delays and are committed to resolving outstanding orders. Your patience and cooperation are a condition of purchase.

5. VIP Club Subscription Membership

BY PURCHASING A PRODUCT AT A DISCOUNTED RATE OR WITH FREE SHIPPING, YOU ARE OPTING IN TO THE VACPACK VIP CLUB MEMBERSHIP (THE "VIP CLUB").

The VIP Club is an optional recurring membership program that provides members with exclusive benefits, including but not limited to discounted pricing on future orders, free or reduced shipping on qualifying purchases, early access to new products, members-only promotions, and other perks that may be updated from time to time.

Membership details:

  • Automatic Enrollment: When you complete a qualifying purchase at a discounted rate or with free shipping, you will be automatically enrolled in the VIP Club unless you clearly opt out before completing checkout.
  • Recurring Billing: VIP Club membership is a recurring subscription. Your payment method will be charged the then-current membership fee on a monthly basis until you cancel.
  • Membership Fee: The monthly fee, billing date, and any trial terms will be disclosed at checkout and in your order confirmation. Fees are subject to change with reasonable notice.
  • Benefits Updated Monthly: VIP Club benefits, discounts, and eligible products are reviewed and updated monthly. Specific offers, discount percentages, and product availability may change without notice.
  • Free Shipping: Free shipping is a VIP Club benefit on qualifying orders as determined by VacPack and may exclude oversized, expedited, or international shipments.
  • No Obligation to Purchase: Membership does not obligate you to make additional purchases, but the recurring membership fee will continue to be charged unless canceled.

You may cancel your VIP Club membership at any time by contacting our customer support team at info@getvacpack.com or by following the cancellation instructions included in your membership communications. Cancellation will take effect at the end of the current billing period, and no refunds will be provided for partial months. If you cancel, you will lose access to VIP Club benefits immediately upon the effective cancellation date.

6. Shipping & Delivery

We currently ship to addresses within the United States and select international destinations. Shipping options, rates, and estimated delivery times are presented at checkout and are estimates only. We are not responsible for delays caused by customs, weather, carrier disruptions, incorrect addresses, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. If a package is returned to us due to an incorrect or incomplete address, you may be required to pay additional shipping charges to resend the order.

For international orders, you are responsible for any import duties, taxes, customs fees, or brokerage charges imposed by your country. These charges are not included in the product or shipping price and are collected by the carrier or local customs authority.

7. Returns, Refunds & Exchanges — ALL SALES FINAL

ALL SALES ARE FINAL. ABSOLUTELY NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES.

By placing an order with VacPack, you expressly acknowledge, understand, and agree that every purchase is final and non-refundable. This no-refund policy applies without exception to all Products, bundles, promotional purchases, discounted orders, VIP Club membership fees, shipping charges, add-ons, protection plans, and any other item, service, or fee purchased through our Services.

Without limiting the foregoing, we do not issue refunds, partial refunds, store credit, or chargeback accommodations for any of the following reasons:

  • Delayed, slow, or extended shipping and fulfillment timelines, regardless of the length of the delay.
  • Orders that have not yet arrived, are still in transit, are stuck in customs, or are otherwise pending delivery.
  • Orders lost, stolen, misdelivered, damaged, or destroyed by any Fulfillment Partner or shipping carrier.
  • Buyer's remorse, change of mind, ordering the wrong Product, ordering the wrong quantity, or ordering the wrong variant.
  • Failure of a Product to meet a customer's subjective expectations regarding fit, size, capacity, color, appearance, or airline compatibility.
  • Any issue caused or contributed to by a third-party Fulfillment Partner, warehouse, manufacturer, or carrier (see Section 4).
  • VIP Club membership fees, which are non-refundable in full for any billing period once billed.
  • Promotional, discounted, bundled, clearance, or free-shipping orders of any kind.

We do not offer returns, exchanges, cancellations, or refunds after an order has been submitted. Requests for refunds, cancellations, or chargebacks based on any of the reasons above will be denied. Initiating a chargeback, payment dispute, or reversal in violation of these Terms constitutes a material breach of this agreement, and we reserve the right to pursue all available remedies, including but not limited to recovery of the disputed amount, associated fees, collection costs, and reasonable attorneys' fees.

If your order is delayed or has not yet arrived, please contact us at info@getvacpack.com and we will work in good faith with our Fulfillment Partners and carriers to help locate your shipment or arrange a replacement where reasonably possible. Any replacement, reshipment, or resolution offered is provided at VacPack's sole discretion as a courtesy and does not create an obligation, precedent, or right to a refund.

In the rare event a Product arrives with a verified manufacturing defect, contact us within 7 days of delivery with photo evidence and your order number. At our sole discretion, we may offer a replacement of the defective item. Even in this case, no cash, credit, or monetary refund will be issued.

8. Product Use, Safety & Assumption of Risk

VacPack Products are intended for lawful personal travel and storage use. You agree to use each Product only as intended and in accordance with any instructions, warnings, or guidelines provided with the Product.

You assume all risk associated with the use of our Products, including but not limited to over-packing, exceeding airline weight limits, damage to contents caused by compression, battery use, and travel-related incidents. VacPack is not liable for personal injury, property damage, lost contents, airline fees, missed flights, or any other losses arising from the use or misuse of our Products.

9. Intellectual Property

All content on the VacPack website, including text, graphics, logos, images, videos, product designs, trademarks, and software, is the property of VacPack or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent.

10. Privacy & Communications

By using our Services or placing an order, you consent to receive communications from us, including order confirmations, shipping updates, marketing emails, SMS messages, and VIP Club notifications. You may opt out of marketing communications at any time by following the unsubscribe instructions included in those messages.

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

11. Limitation of Liability

To the fullest extent permitted by applicable law, VacPack and its owners, employees, agents, affiliates, and Fulfillment Partners shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, or business interruption, arising out of or relating to these Terms, the Services, or any Product, even if advised of the possibility of such damages.

In no event shall our total aggregate liability exceed the total amount you actually paid to VacPack for the specific Product or order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless VacPack and its officers, directors, employees, agents, affiliates, and Fulfillment Partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, your misuse of any Product, or your violation of any third-party right.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved exclusively through binding arbitration in Delaware, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
